5-165. Matters to Be Considered When Considering a Rezoning Request.
When the Planning Commission is deciding whether to recommend approval or disapproval of a rezoning request and when the City Council is acting on a rezoning request, the Planning Commission and City Council shall consider the following matters:
A. The character of the neighborhood;
B. The zoning and uses of properties nearby;
C. The suitability of the subject property for the uses to which it has been restricted;
D. The extent to which the removal of restrictions will detrimentally affect nearby properties;
E. The length of time the subject property has remained vacant as zoned;
F. The relative gain to public health, safety and welfare by the destruction of the value of plaintiff’s property as compared to the hardship imposed upon the individual owner;
G. Consideration of the recommendations of permanent City staff; and
H. The conformance of the requested change to the Comprehensive Plan. [Ord. 1267, 09-14-09.]
