A. Fences and Walls Combined. The total height of Fences and Walls (as determined in Section 5-138.G) built in combination shall not exceed established height limitations.

B. Fences and Retaining Walls Combined. A Fence may be located on top of an approved Retaining Wall provided that the total height of the Fence and Retaining Wall (as determined in Section 5-138.G) does not exceed the height limitations established for Fences.

C. Building Line Restriction. No Fence, Wall or Gate, except for Retaining Walls, shall be located closer to Street lines than the applicable Building Lines of the Lot.

D. Certain Outdoor Recreational Facilities. Notwithstanding any other provision of Sections 5-133 through 5-138, a Fence or Gate intended as a back or side stop for a sport court that is located immediately adjacent to the surface floor of the sport court may be no more than ten feet (10') in height or the height of the Fence to which the Gate is attached; provided, that the surface area of each section of the Fence has a minimum of fifty percent (50%) open area allowing an unobstructed view through the Fence.

E. Dog Containment Area. Notwithstanding any other provision of Sections 5-133 through 5-138, a Fence that is used solely to contain a dog or dogs may be no more than six feet (6') in height; provided, that it encloses no more than one hundred square feet (100 sq. ft.) in area and is located solely in the Rear Yard no closer than ten feet (10') from either side or rear property line. The dog containment area must be located within a privacy Fence.

F. Proximity to Other Fences. No Fence shall be located closer than three feet (3') to another Fence located on the same Lot.

G. Determination of Height. The height of a Fence or Wall or combination thereof shall be determined by measuring the distance from finished grade on the side facing outwardly to a Street or neighboring Lot to the highest point of the Fence or Wall, excluding posts. Where a Fence is built on top of a Retaining Wall, the height of the Fence shall be determined by measuring the distance from finished grade on the side facing outwardly to a Street or neighboring Lot to the highest point of the Fence, excluding posts. Where the terrain is irregular, the City Administrator shall determine the height by calculating the mean height of an appropriate Fence, Wall, or Retaining Wall section; provided, that the section shall not be more than ten feet (10') in length.

H. Unique Circumstances. The height requirements established by this Section 5-138 may be exceeded by not more than six inches (6") in situations where such additional height is necessary to allow for normal installation.

I. Fences, Walls, and Gates in Districts C-1 and D-1. No provision contained in Section 5-133 or any section of the Zoning Regulations shall apply to any City property. No Fence, Wall or Gate for any other property located in District C-1 or D-1 may be constructed without the approval of the ARB. In considering an application to construct such a Fence, Wall or Gate, the ARB shall apply the standards set forth in Section 5-146 and, in doing so, may impose such limitations on height, location, materials and design as the ARB, in its sole discretion, deems appropriate.

J. Construction Fence or Gate. Notwithstanding any other provision of Sections 5-133 through 5-138, the City Administrator may require the erection of a Construction Fence to enclose and conceal a demolition or construction site to protect the public, and such Construction Fence shall be of a height, material and at a location deemed necessary by the City Administrator.
